Terms of service
1. Scope These General Terms & Conditions (GTC) govern all orders placed through www.houseofhygge.ch (the “Shop”), operated by sCHNOw Sàrl, 1700 Fribourg (“we”, “us”). They apply to consumers and business customers resident in Switzerland and the Principality of Liechtenstein. By placing an order you accept these GTC in the version valid at the time of the order.
2. Conclusion of contract The presentation of products in the Shop is an invitation to order, not a binding offer. By completing checkout you make a binding offer to purchase. The contract is concluded when we confirm your order by email (order or shipping confirmation). We may decline an order, for example where a product is unavailable or the price was displayed in error.
3. Prices and VAT All prices are in Swiss francs (CHF) and include Swiss value added tax (VAT) at the applicable rate (currently 8.1%). Shipping costs are shown separately before you complete the order. The price valid at the time of the order applies.
4. Payment We accept the payment methods displayed at checkout, which may include TWINT, credit and debit cards, and PayPal. Payment is due on conclusion of the contract unless another arrangement is shown. We reserve the right to refuse individual payment methods for a given order.
5. Delivery We deliver within Switzerland and Liechtenstein. Delivery times are stated in the Shipping Policy and are estimates, not guaranteed dates. If a product is delayed or unavailable after your order, we will inform you promptly; any amount already paid for an undeliverable item is refunded.
6. Retention of title Delivered goods remain our property until full payment has been received.
7. Cancellation and returns Swiss law provides no general statutory right of withdrawal for online purchases. As a goodwill gesture we offer a voluntary return right on the terms set out in our Returns & Refunds Policy, which forms part of these GTC.
8. Warranty for defects The statutory warranty for defects under the Swiss Code of Obligations (art. 197 ff.) applies. If a delivered product is defective, please contact us at info@houseofhygge.ch. We will, at our discretion, repair, replace, or refund the product in accordance with the applicable statutory provisions.
9. Liability We are liable without limitation for damage caused intentionally or through gross negligence, and for injury to life, body or health. Any further liability, in particular for slight negligence and for indirect or consequential damage, is excluded to the extent permitted by law.
10. Data protection We process personal data in accordance with our Privacy Policy and the Swiss Federal Act on Data Protection (revDSG).
11. Applicable law and jurisdiction Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law rules. The exclusive place of jurisdiction is Fribourg, Switzerland, subject to any mandatory place of jurisdiction for consumers.
12. Severability Should any provision of these GTC be or become invalid, the validity of the remaining provisions is unaffected.
